General terms and conditions and consumer information

1. Scope

The general terms and conditions (hereinafter also referred to as GTC) form the basis and apply to all orders placed via our (contractual partner, point 2) online shop.

3. Conclusion of contract

By presenting our products in our online shop, we are making a binding offer to conclude a purchase agreement. You can initially place the desired items in your shopping cart without obligation and adjust your entries at any time during the ordering process before submitting your binding order.
The contract is concluded as soon as you accept our offer for the items in your shopping cart by clicking the order button. You will receive an order confirmation by email immediately after submitting your order.

The contract language is German. We save the contract text and send you the order details by email. You can view and download our terms and conditions at any time on this page. The terms and conditions in their current version apply.

4. Delivery & Shipping

Your order will be shipped as soon as we receive it and confirm payment. In the unlikely event of delays or if a product is unexpectedly unavailable, we will inform you immediately. For orders containing multiple products, we reserve the right to make partial deliveries, provided these are reasonable for both you and us. The delivery time begins once we have shipped your package and you have received a shipping confirmation from us. Based on experience, the package will typically arrive at your chosen address within 7 business days.

Shipping is handled by our partner, Austrian Post. During the ordering process, you can choose between standard shipping, shipping to a Post Office Pick-Up Station, or in-store pickup via Click & Collect. If you choose Click & Collect (pick-up at the Contact Lens Lounge), we will notify you by email as soon as your order is ready for collection.


5. Shipping costs

Shipping within Austria:
For orders within Austria, shipping costs of €6.50 apply. Orders over €69 qualify for free shipping.


Shipping to: Germany:
For orders to Germany, shipping costs of €15.00 will apply.


Shipping to other EU countries
For orders to other EU countries, shipping costs of €22.08 will apply.


Shipping to non-EU countries
If you wish to have an order delivered to a country outside the EU, please contact us by phone beforehand. Please understand that the costs and expenses for all customs documentation are your responsibility.


6. Payment

In addition to the stated product prices, shipping costs may apply depending on the delivery country and payment method. Further details regarding shipping costs can be found under point 5.
The goods will only be shipped to you after we have received your payment.
The following payment methods are available:

Apple Pay/Google Pay
If you choose to pay via Apple Pay or Google Pay, the transaction will be processed by the payment provider Stripe. Your payment information will be processed securely by Stripe. Your payment will be charged immediately after you complete your order.


Credit/Debit card
By selecting "Credit Card" as your payment method, your credit card or other payment data will be processed by the payment service provider Stripe. Your credit/debit card will be charged automatically by the credit card company after order completion.

PayPal
There are no additional fees for you when paying via PayPal.
Payment is processed via the online payment provider PayPal. During the checkout process, you will be redirected to the PayPal website. There, you must either be already registered or register, enter your login details, and confirm the payment instruction to us (unless you are using guest checkout). After you complete your order in our shop, we will request PayPal to process the payment transaction. You will receive further information about this during the checkout process.


prepayment
If you select prepayment as your payment method, you will receive an invoice from us at the email address you provided after placing your order, specifically with the order confirmation. You will find our bank details both on the invoice and on the website. Your order will be shipped after payment has been received.

7. Cancellation of the purchase agreement

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day after you receive the goods.

7.1. Right of withdrawal
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear written statement.
For a written declaration of your decision, a letter sent by post, an email or the sample cancellation form below is sufficient.
To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires (14 days from the day after receiving the goods) to the following address or email address.

7.2. Consequences of revocation

If you cancel your contract, we will refund all payments received from you upon conclusion of the contract, including delivery costs.

Since our online shop deals with health and hygiene products that are delivered sealed, we reserve the right to refund your payment within 14 days only after receiving the returned goods and inspecting them.

For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

You must return or hand over the goods to us (in person at the shop) without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract.
The deadline is met if you send the goods before the end of the fourteen-day period.
Unless otherwise agreed, the customer shall bear the direct costs of returning the goods to us.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for testing their condition, properties and functionality.

7.3. Exceptions to the right of withdrawal
There is no right of withdrawal for the following contracts:

Contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the customer is decisive or which are clearly tailored to the personal needs of the customer.

Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed or damaged after delivery and the original packaging is damaged.

7.4 Marked Products
Products such as sunglasses, marked as discontinued models or individual items from previous collections (as indicated in the product description) and offered at a reduced price, are excluded from exchange and returns. Spare parts are not available for these products. By purchasing, the customer expressly agrees to these terms and conditions.


8. Retention of title

The goods remain our property until full payment is received.


9. Transport damage

Should you notice any visible transport damage to the goods upon delivery, please report this immediately to the transport company and contact us within one working day.


10. Warranty & Guarantees

Your statutory warranty rights and liability under the Product Liability Act remain unaffected. You are entitled to the statutory warranty rights under the Consumer Warranty Act (VGG). In the event of defects, subsequent performance will be carried out by repair or replacement. Products with a best-before date: the warranty is valid until this date. Voluntary guarantees only apply if they are expressly stated.


11. Data protection

Information on the GDPR guidelines and your rights can be found under the heading "Data Protection" on our website, where you can also access the content of any consent declaration you may have given at any time.

12. Information on consumer dispute resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Should you have a disagreement with us, you can contact the relevant consumer arbitration board. Further information on consumer dispute resolution can be found on the official information pages of the responsible authorities.

13. Special instructions for purchasing contact lenses and care products

The above information regarding contact lenses, care products, and health aspects is provided solely for informational purposes and to ensure the safe use of the products. It does not constitute... no exclusion of liability or warranty and change not Your legal rights, in particular those under the Consumer Warranty Act (VGG) or the Product Liability Act:
When purchasing contact lenses, certain conditions apply to protect eye health. The buyer confirms that the lenses have already been fitted and recommended by an ophthalmologist or optician and that they tolerate them well. Furthermore, the ordered prescription must match a fitting that is no more than 12 months old. The buyer is experienced in handling and caring for the lenses and attends regular check-ups. There is no medical recommendation to discontinue wearing them. In case of eye irritation, vision problems, or redness, the buyer will remove the lenses immediately and contact an eye care professional.

Please read the package insert for risks and side effects of contact lenses and care products. The stated wearing times assume proper handling and care of the contact lenses and must not be exceeded. Please use only the recommended contact lens care products. If you experience unexpected eye irritation, you should remove the contact lenses immediately and consult an ophthalmologist or contact lens specialist.


14. Reordering via online form for existing customers

Reordering via the contact form provided on our website “Simply reorderThis service is exclusively available to existing customers whose individual lens values and orders are stored with us. A prerequisite is that the data stored with us is current and accurate.

By submitting the contact form, the customer makes a non-binding inquiry. After reviewing the customer data provided, we will send an invoice via email within one business day. The purchase agreement is concluded upon our confirmation via email and the attached invoice.

Delivery will be made after full payment has been received in the account specified on the invoice. Unless the customer specifies a different delivery address, the order will be sent to the delivery address last saved in our system.

For care products: Unless the customer specifies otherwise in the comment field, delivery will be in a quantity corresponding to the individual lens supply.

The customer is obligated to check the accuracy and completeness of the information provided in the contact form. We assume no liability for delays or incorrect deliveries resulting from incorrect or incomplete information.

Technical transmission errors or temporary unavailability of the contact form do not constitute grounds for cancellation. In such cases, the customer has the option of placing orders via alternative communication channels (e.g., email, telephone).

Should any uncertainties or questions arise in connection with a reorder, we will contact you via the email address provided by the customer in the form.

The customer data provided will be stored exclusively for processing and billing orders of this type.


15. Applicable Law

Contracts concluded with us are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-laws rules of private international law. The statutory rights of consumers, in particular under the Consumer Warranty Act (VGG) and the Product Liability Act, remain unaffected.
